1. Introduction & Acceptance

These Terms and Conditions ("Terms") form a legally binding agreement between you ("User", "you") and KAWHUDS GROUP LTD, registered in England & Wales under company number 17092932 ("Partshunter", "we", "us"). By registering, accessing, or using the Partshunter mobile application or website at partshunter.co.uk ("Platform"), you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, you must cease using the Platform immediately.

⚠️ These Terms contain important limitations on our liability and provisions that significantly affect your legal rights. Please read them carefully before using the Platform.

2. Nature of the Platform

Partshunter is a technology marketplace platform only. We provide infrastructure enabling buyers to post spare part requests and verified sellers to respond with quotes. We are not a seller, retailer, distributor, agent, or manufacturer of any spare parts listed. We hold no inventory. The contract for the purchase and sale of any part is formed exclusively and directly between the buyer and the seller.

Partshunter's role is strictly limited to: (a) facilitating introductions between buyers and sellers; (b) broadcasting part requests; (c) processing payments as a payment intermediary on behalf of sellers; and (d) providing a dispute mediation service. Nothing in these Terms or on the Platform constitutes Partshunter as a party to any transaction.

An order is formed when a buyer formally accepts a seller's quote via the Platform. A binding agreement is created at that moment between the buyer and seller, subject to these Terms.

12. Intellectual Property

All Platform content β€” including trademarks, logos, software, text, images, and UI design β€” is owned by or licensed to KAWHUDS GROUP LTD. You may not reproduce, distribute, modify, reverse-engineer, or create derivative works from any Platform content without our prior written consent. By submitting content to the Platform (photos, descriptions, reviews), you grant Partshunter a non-exclusive, worldwide, royalty-free, perpetual licence to use, display, and distribute such content in connection with the Platform's operation and promotion.

To the fullest extent permitted by applicable law:

You agree to indemnify, defend, and hold harmless KAWHUDS GROUP LTD and its directors, officers, employees, contractors, and agents from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Platform; (b) your breach of these Terms; (c) your violation of any third-party rights or applicable law; (d) any content you submit to the Platform; or (e) any dispute between you and another user.

15. Dispute Resolution

  1. Direct Resolution: Parties must first attempt to resolve disputes directly via the in-app messaging system within 48 hours of the issue arising.
  2. Formal Dispute: If unresolved, either party may submit a formal dispute to disputes@partshunter.co.uk with full documentation and evidence.
  3. Review Period: Partshunter will acknowledge the dispute within 2 working days and issue a decision within 10 working days of receiving all required information.
  4. Payment Holds: Partshunter reserves the right to hold any funds in escrow pending the outcome of a dispute.
  5. Finality: Partshunter's dispute decisions are made in good faith but are not legally binding arbitration awards. Either party retains the right to pursue independent legal remedies.
  6. Escalation: Unresolved escalations may be referred to management at management@partshunter.co.uk.

16. Account Suspension & Termination

We may suspend, restrict access to, or permanently terminate any account at our sole discretion and without prior notice if we reasonably believe a user has:

Upon termination, your right to access the Platform ceases immediately. All outstanding obligations survive termination. No fees are refunded upon suspension for cause. Users who believe a suspension was made in error may appeal to management@partshunter.co.uk.

17. Privacy & Data Protection

Your use of the Platform is governed by our Privacy Policy, incorporated herein by reference. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

18. Amendments

We may update these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Continued use of the Platform following notification constitutes acceptance of the revised Terms.

19. Governing Law & Jurisdiction

These Terms and any disputes arising in connection with them shall be governed by the laws of England and Wales. Both parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any applicable mandatory consumer protection provisions in a user's country of residence.

Refund Policy

As Partshunter is a marketplace, primary refund obligations rest with the seller. However, Partshunter will mediate all disputes and may facilitate refunds of platform-processed payments where justified under this Policy.

  1. Submit a dispute via the in-app dispute centre or email disputes@partshunter.co.uk within 48 hours of the issue arising (or within 48 hours of the expected delivery date for non-delivery claims).
  2. Include: order reference number, description of the issue, clear photographic or video evidence, and all relevant communications with the seller.
  3. Partshunter will acknowledge the dispute within 2 working days and may request additional supporting information.
  4. A decision will be communicated within 5–10 working days of receiving all required information.

Partshunter may determine that a partial refund is appropriate β€” for example, where part of a multi-item order was affected, or where a minor discrepancy existed. The basis for any partial refund will be communicated clearly in writing.

6. Escalation

If you are dissatisfied with a refund decision, you may escalate in writing to management@partshunter.co.uk. All statutory rights under applicable law are preserved regardless of this internal process.

7. Fraudulent Refund Claims

Any user found to have submitted a fraudulent, fabricated, or exaggerated refund claim will have their account immediately suspended and may face legal action and/or reporting to relevant authorities. Partshunter reserves the right to pursue recovery of any amounts paid out on the basis of fraudulent claims.

  1. Report the issue within 48 hours of receiving the item via the in-app dispute centre or at disputes@partshunter.co.uk.
  2. Provide photographic or video evidence, your order reference, and a clear description of the fault or mismatch.
  3. Partshunter will review evidence and determine whether the return qualifies within 3 working days.
  4. If approved, Partshunter will issue a Return Authorisation Number (RAN). Do not return any item without a valid RAN. Unauthorised returns will not be processed or credited.
  5. Items must be returned in the same condition as received, securely packaged, with all original components where applicable.
  6. Upon receipt and verification by the seller, a refund or exchange will be processed under the relevant policy.

Partshunter mediates return and exchange disputes but is not a party to the sale contract. We will use commercially reasonable efforts to facilitate fair outcomes. Sellers who repeatedly fail to honour legitimate return requests will face account suspension. Buyers who abuse the returns process may also face account action.
